These Terms and Conditions ("the Terms") govern the relationship between Aymara Cepero-Vargas, trading as "Mar de Vargas" ("the Provider"), and any person who books or purchases any of her services ("the Client"): individual, couple, or family sessions, the ROOTS™ program, session packs, or digital products from the Book Shop.
Booking a session, paying for any service, or using the materials provided constitutes full and unconditional acceptance of these Terms.
2.1. The services offered combine integrative psychotherapy, mentoring, and expressive processes, aimed at supporting international transitions, identity, and personal well-being.
2.2. No guarantee of outcome clause. The Provider undertakes to make available to the Client her professional training, experience, and diligence in carrying out the agreed process ("obligation of means"). The Provider does not guarantee, under any circumstances, a specific result, transformation, or emotional or professional improvement. The outcomes of any therapeutic, mentoring, or support process depend on multiple factors beyond the Provider's control, including — without limitation — the Client's engagement, personal circumstances, and external factors.
2.3. None of the services offered constitute psychiatric treatment, clinical diagnosis, or a substitute for medical or emergency care. If the Client is experiencing an acute crisis, suicidal ideation, or requires immediate medical attention, they must contact the emergency services of their country of residence. The Provider reserves the right to suspend or refer any process if the Client's situation is found to exceed the scope of these services.
2.4. The ROOTS™ Program is not designed to treat diagnosed clinical pathology. Should such a need arise during the process, the Provider will communicate this honestly to the Client and help them find appropriate resources, without this constituting a breach of these Terms.
Services involving minors (family sessions, processes including the Client's children) require the express consent and presence or authorization of the person holding parental authority or legal guardianship. The Provider does not offer services independently directed at minors without the involvement of a responsible adult.
4.1. Prices in effect are those published on the website at the time of booking or purchase, in euros, taxes included where applicable.
4.2. Payment is processed via the Stripe payment gateway. Session bookings are managed via TidyCal. Payment confirmation constitutes booking confirmation.
4.3. Session packs are valid for a limited period (3, 5, or 10 months depending on the pack purchased, as specified at time of purchase), after which unused sessions are considered expired, with no right to refund or extension, except in duly documented cases of force majeure.
5.1. The Client may reschedule or cancel an individual session with a minimum of 48 hours' notice, at no additional cost.
5.2. Cancellations with less than 48 hours' notice, or failure to attend without notice ("no-show"), are non-refundable and non-reschedulable.
5.3. Session packs and the complete ROOTS™ Program are non-refundable once the process has begun, except as provided in Clause 6.
5.4. The Assessment (diagnostic session) is deductible from the price of the complete ROOTS™ Program if the Client decides to continue within 30 days of completing it.
If, after completing the first two sessions of the ROOTS™ Program, the Client believes in good faith that the process is not suitable for their situation, they may request to discontinue the program. In that case, only the sessions and services actually provided up to that point will be charged, with the remaining balance refunded. This clause does not apply after the first two sessions, nor to individual session packs.
7.1. The Provider undertakes to maintain the confidentiality of all information shared by the Client during the process, in accordance with applicable professional ethics.
7.2. This confidentiality has legal and ethical limits: the Provider may, and where applicable must, break confidentiality where there is a serious and imminent risk to the life or safety of the Client or third parties, where required by a competent judicial authority, or in other cases provided for by applicable law.
The Client agrees to provide truthful information about their situation, to inform the Provider of any relevant medical or psychiatric condition they are aware of, and to take responsibility for seeking medical or emergency care when the situation requires it, regardless of the ongoing process with the Provider.
All materials provided (guides, workbooks, personalized reports, Book Shop resources) are for the Client's personal and exclusive use. Reproduction, distribution, resale, or making available to third parties, in whole or in part, without prior written authorization, is prohibited.
10.1. To the fullest extent permitted by applicable law, the Provider's total liability to the Client, on any grounds arising from the provision of services, is limited to the amount actually paid by the Client for the service in question.
10.2. The Provider is not liable for indirect damages, loss of profit, or consequences arising from personal, professional, or financial decisions the Client makes during or after the process, it being understood that such decisions are the Client's sole responsibility.
10.3. The Provider is not liable for service interruptions arising from force majeure, failures of third-party technology platforms (Stripe, TidyCal, GoHighLevel), or circumstances beyond her reasonable control.
The processing of personal data is governed by the Privacy Policy published on the website, which forms an integral part of these Terms.
The Provider may modify these Terms at any time. Changes apply to bookings made after publication; processes already underway remain governed by the Terms in effect at the time they began, unless changes are legally required.
These Terms are governed by French law. For any dispute that cannot be resolved amicably, and without prejudice to any mandatory consumer-protection rules that may apply in the Client's country of residence, the French courts shall have jurisdiction.
